Appellate panel upholds Dr. Kauffman's pretrial detention

  • News

The detention of an Egg Harbor Township doctor pending trial on a gun charge was upheld last week.
Dr. James Kauffman has been jailed since June 13, when he pulled a gun as detectives and FBI agents came with a warrant to search his office and files.
A Linwood police officer's body camera caught much of the standoff, and was shown at Kauffman's detention hearing as evidence of why he should not be released.
The video shows Kauffman is a flight risk and a danger, Chief Assistant Prosecutor Seth Levy said during the June 19 appearance before Superior Court Judge Bernard DeLury.
“I’m not going to jail for this!” Kauffman is heard saying.
He also threatens to kill himself.
The warrant is part of an ongoing, multi-agency investigation related to health insurance fraud, according to various sources. At least one of the warrants mentioned both "various species" of medical fraud and "a homicide," defense attorney Ed Jacobs said.
Kauffman previously fought a motion by the Atlantic County Prosecutor's Office to give a DNA sample in the ongoing investigation into his wife's killing May 10, 2012, inside the bedroom of their Linwood home.
The decision in that case was sealed. Kauffman has denied any involvement in his wife's death.
As for his weapon charges, he will stay in the Atlantic County Justice Facility after a two-judge appellate panel — which also viewed the video — agreed with DeLury.
"The judge's decision was thorough and was supported by substantial credible evidence," read the decision by Judges Susan Reisner and Karen Suter.
Jacobs did not immediately return a request for comment.
