Absecon man convicted in aggravated assault on elderly woman

  • News
An Absecon man was convicted last week in an assault that left an elderly woman with a broken nose, cracked rib and scar above her eye. Brian Auxer, 31, and his mother had been living with the victim when the July 3, 2016, assault occurred. Auxer was angered after arguing with his mother, Assistant Prosecutor Kathleen Robinson told the jury in her closing argument. “I thought I was going to die,” the victim testified about the attack, in which Auxer knocked her to the ground and continued to punch her in the head and stomach. Auxer’s mother left to go get cigarettes, she testified during the three-day trial. But “I suggest to you, Linda Auxer left because they were arguing,” Robinson said. “Still angry, still wanting to fight, (Brian Auxer) turned his attack to (the victim),” she said. After the attack, Auxer “left her there, in the home she opened up to him, lying in a puddle of blood.” The victim had to rush next door for help. Her neighbors described her as “bloody and hysterical” when they opened the door. Auxer faces five to 10 years in prison when he is sentenced May 25 before Superior Court Judge Jeffrey Waldman. Any sentence would be subject to the No Early Release Act, meaning he would have to serve at least 85 percent before he is eligible for parole.
