Atlantic City brothers get 50 years in 2013 killing

Two Atlantic City brothers already serving federal life sentences for their part in a violent drug-trafficking gang were given 50 years each Wednesday in a fatal 2013 shooting. Mykal and Malik Derry continued to deny their part in the killing of Tyquinn James, which was captured on surveillance video. Malik Derry, 27, "I want to apologize to the family over the hardship that they had to go through," said Malik Derry, 27, the man convicted of biking by James the night of Feb. 10, 2013, and carrying out the killing at his brother's request. "But I'm still not guilty." https://youtu.be/lfYmqhuGlps His 38-year-old brother, Mykal Derry, offered no apology, instead saying he didn't receive a fair trial — as he alleged right after the jurors rendered their verdict. James left behind a daughter, now 7, Chief Assistant Prosecutor Erik Bergman said. The girl's mother was in the courtroom, but decided not to address the court. But she wanted the judge to know "Mr. James was an outstanding father," Bergman said. After his sentencing, Mykal Derry stared over at the woman, smiling. He then mouthed a curse word at her. She said something back and, as he was led out of the courtroom, he loudly called her the same name he had mouthed. Superior Court Judge John Rauh gave the men concurrent sentences, meaning the 50 years will not add any time to the federal sentences. He acknowledged that U.S. District Judge Noel Hillman already considered the killing when he sentenced the brothers to life sentences plus 10 years. "It senseless and, quite frankly, callous crime," Bergman quoted from that sentencing. Even worse, was the "celebratory nature" of the intercepted calls and texts the federal investigation revealed.
