A Margate firefighter who also worked as a lifeguard must forfeit both jobs after he was convicted of shoptlifting less than $8 of goods from the local Wawa, a Superior Court judge decided Wednesday.
Ashton Funk , 34, of Northfield, was convicted last December by Egg Harbor Township Municipal Court Judge Robert Switzer.
The state then moved for Funk to forfeit his public employment, arguing that — although he was off-duty at the time of the offense — a public employee is still subject to give up their job if convicted of a defense involving dishonesty. Switzer ordered the forfeiture in January, but Funk appealed.
On Wednesday, Atlantic County Superior Court Judge Bernard DeLury confirmed the forfeiture.
