Committee to file civil suit against Gilliam after judge dismisses criminal charge

Atlantic City Mayor Frank Gilliam is expected to announce Tuesday that his name has been cleared. But the Atlantic City Democratic Committee members that broke away from the leadership that backed him says it's not over. The criminal complaint Committeeman John Devlin filed concerning a $10,000 check meant for the committee but deposited into Gillian's fund has been dismissed, Devlin confirmed at a meeting at the Irish Pub on Monday night. At that same meeting, the group voted to take civil action against the mayor, his campaign manager and TD Bank, which allowed the committee's check to be deposited in Gilliam's account. Gilliam is expected to announce the dismissal at a press conference he is holding at 11 a.m. Tuesday. In a press release, his office said the announcement would "address the court findings in the matter of the State of New Jersey v. Frank Gilliam, Jr., a complaint filed by a private citizens against Mayor Gilliam, alleging theft." While the theft complaint involving the check was apparently dismissed by a judge, that doesn't mean it's over, said Councilman George Tibbitt, who claims there are checks of his involved as well. Tibbitt said he has been interviewed by investigators from the Atlantic County Prosecutor's Office and the FBI involving the checks. Gilliam was not at the Irish Pub meeting. Instead he was at El Charro's on Fairmount Avenue, where he said the real committee meeting was happening. The ousted leadership, including Chairwoman Joyce Mollineaux, has refused to acknowledge a meeting of the committee majority that voted to replace them weeks ago. They have continued to have their monthly meetings at the Mexican restaurant. "We'll talk in a couple of days," Mollineaux told BreakingAC as about seven members readied for a meeting to start at El Charro. At the Irish Pub, about two dozen members of the "other" committee voted to pursue civil litigation against Gilliam, his campaign manager and TD Bank, which allowed the committee's check to be deposited into Gilliam's account.
