A third Stockton University student is claiming she was raped after being fed a funny drink at a Pi Kappa Phi party, a fraternity the school says is not recognized there.
The woman, identified as D.N., says in a federal lawsuit filed Friday that women at the Sept. 23, 2014 party she attended were given a different colored drink than the men, and that after she drank the concoction she blacked out.
She says she woke up the next day, naked and sore in the dorm room of Dan Novak, the then-freshman student who took her to the party.
Novak is a member of the Gamma Mu chapter of Alpha Phi Delta, according to the organization's website, which lists him as secretary.
The woman came forward after two other women said Pi Kappa member Zachary Madle raped them.
Madle, a 25-year-old Stockton graduate, is also charged criminally for allegedly posting one of the encounters on Snapchat.
Novak, who is from Mount Laurel, could not be reached for comment.
As were the allegations in the Madle suits, D.N. claims Stockton did not investigation the attack and does not protect its students from the atmosphere of sexual assault.
Robert Fuggi, the Toms River attorney now representing all three women, told BreakingAC just days before the latest lawsuit that he expected more women to come forward.
“It just seems like there’s an environment there,” he said.
But Stockton spokeswoman Diane D'Amico issued a response saying that "these allegations either have been or are being investigated by Stockton University Campus Police, Galloway Township Police and/or the Atlantic County Prosecutor’s Office."
D.N. suffered depression and severe anxiety after the incident.
About a month after it happened, the suit says Novak said “he was sorry for what had happened a month before.”
She started having dreams that the suit claims were memories of what happened to her when she was incapacitated.
Some time during the spring semester in early 2015, Novak called and texted the woman, who didn’t respond. In one text he “apologized for the night of September 23, 2014.”
He only said that he had sex with her.
While Stockton cannot comment specifically on the allegations at this time, D'Amico said, "there is important information that Stockton University can share:"
"We will continue to update the community as permissible if future," she said.
