A Mays Landing man has been indicted on charges of vehicular homicide and assault by auto in a fatal 2017 crash.
Jeffrey Weiss was stopped at a traffic light on the Black Horse Pike at the intersection of Tower Avenue when he was rear-ended by John Rivera at about 6:20 p.m. June 17, 2017, according to the affidavit.
Weiss was pronounced dead at the scene. His sister, Jean Burrell, suffered four broken ribs, a broken vertebra, a concussion and a herniated disk, the report said.
Blood and urine tests found that Rivera had alprazolam — commonly known as Xanax — in his system at the time of the crash, according to the charges.
Roadway evidence, the damage to both vehicles and their final resting positions, along with statements from Burrell and an independent witness all confirmed how the crash happened, according to the affidavit.
Rivera's statements allegedly contradicted the evidence and statements.
An expert found that the level of the unprescribed drug in Rivera’s system was amounted to chronic use and impaired his ability to operate his vehicle, the affidavit states.
Rivera, now 30, was indicted last week, and is in the Atlantic County Justice Facility.
