An Atlantic City man accused in a New Year's Day killing will remain in the Atlantic County Justice Facility, after deciding not to fight his detention.
Jamie Sewell, 53, is accused of fatally shooting 21-year-old Lamir King while the younger man was parked inside his car on Lincoln Avenue in Atlantic City at about 6:25 p.m. Jan. 1.
Video footage and cell phone data put Sewell at the scene, according to the affidavit of probable cause.
Under bail reform, there is no monetary bail, but the prosecutor can ask that a defendant be detained pending trial.
In this case, a public safety assessment recommended detention due to the nature of the crime.
Sewell's attorney, Durann Neil, said they had just received the evidence in the case, and would not be arguing against detention at this time.
But he did reserve the right to argue for release at a later date, if he is able to get evidence to support it.
Superior Court Judge Bernard DeLury approved the move, after making sure Sewell agreed and understood his rights.
It's unlikely Sewell will be back in court before his case goes before a grand jury for indictment.
Assistant Prosecutor Rick McKelvey told the judge he would advise the court if a date was necessary before then.
Those who know Sewell said he has never been violent and that they don't believe he would kill someone.
His criminal record dates to 1986, but he has no violent crimes. Most are drug cases, with at least one theft by unlawful taking.
