An Atlantic City man is ready to take responsibility for a gun he threw out a car window as he and four others fled police following a fatal shooting at a Pleasantville High School football game.
But the state is not ready to reach a deal, the attorney for Tyrell Dorn said Thursday.
Four men were arrested after police followed their car as people ran from the shooting that killed 10-year-old Micah "Dew" Tennant and injured two others.
Dorn, 28, wrote an affidavit saying the others in the car didn't know about the gun, and that it was he who threw it out the window.
His attorney, Michael Schreiber, previously told BreakingAC that his client was looking to take responsibility but wants to make sure he can get a deal that such a charge normally would received.
Instead, he said he worries it has been tied to a child's killing, even though none of the four men are charged in that case.
"I asked them for a five do 3½ (years)," Schreiber told the judge Thursday. "I guess it's not resolved."
Assistant Prosecutor Edmund Mallqui-Burgos was not in court.
Standing in for him, Assistant Prosecutor Marissa McGarvey told the judge that her colleague cited the ongoing investigation and discovery.
Dorn along with Vance Golden, Michael Mack and Shahid Dixon drew attention from police among those running from the gunshots Nov. 11, at the high school football playoff game.
Officers tried to stop the car, but it continued on, until after the gun was tossed out the window.
Ibn Abdullah, allegedly the intended target, was injured. He also faces charged himself after he was found with a gun as rescue workers tended to him.
Alvin Wyatt is charged in the killing of Micah and with wounding Abdullah and a 15-year-old boy. He was arrested at the scene.
