Ventnor man accused of rape released with conditions

A Ventnor man accused of sexually assaulting a woman who recorded audio of the alleged attack was released with conditions this week.
Scott Dougherty, 29, is accused of raping the victim in the bedroom of her Somers Point residence.
The affidavit quotes Dougherty saying, "You know how it is when you're in the honeymoon stage of things and a girl is laying naked in front of you and she's telling you do it, no don't do it?"
The woman turned on her cell phone's audio recorder and recorded the encounter because she "was concerned about her safety due to a prior aggressive sexual encounter with this defendant," the affidavit states.
Defense attorney Michael Schreiber took issue with the fact that the state has not yet released the recording to him, despite it being referenced and others having heard it.
"I've heard it went viral," he later told a BreakingAC reporter, who has heard the three-minute recording.
The public safety assessment recommended Dougherty not be released. But the judge cited no serious prior record as part of his reason in allowing release with the strictest conditions.
Dougherty, who was a resident at a sober living house in Ventnor, was released to his parents, who live in Delaware.
He must check in with the court once a week, can have no contact with the victim, no social media and attend substance abuse counseling at least three times a week.
