Pleasantville man held in Atlantic City shooting

A Pleasantville man on parole in an attempted murder was ordered held Tuesday in an Atlantic City shooting.

Vincent Aires, 29, is accused of a shooting at a man after an altercation outside Kelsey’s at Pacific and Kentucky avenues.

The fight allegedly started inside the restaurant and continued outside, after the two were told to leave, Assistant Erika Halayko told the judge.

Video surveillance shows Aires running toward Samar Smiley, shooting a handgun, according to the affidavit. Smiley was not struck.

The ShotSpotter audio gunshot-detection system registered 18 shots. One shell was found lodged in the restaurant.

Aires, who served a prison sentence for attempted murder in Pennsylvania, was identified with help from his parole officer, Halayko said.

But defense attorney Duran Neil told Judge Pam D’Arcy that there was no proof that the shooter was his client, and that the parole officer identified Aires only after police released a photo of his client. That photo, he noted, was not from the surveillance video, which the state has not yet provided to the defense.

“It not our obligation to turn (the video) over at this time,” Halayko argued.

The state did submit 148 pages of discovery, she said.

Aires was identified by witness tips, which included the car he was driving, a partial license plate and identifying his children’s mother, who was with him, Halayko said.

A parole violation has not been filed at this time, but “just because they haven’t doesn’t mean they won’t,” Halayko said in arguing for detention.

D’Arcy agreed with Halayko and the public safety assessment, which recommended no release.

Aires will now be held pending the outcome of his case.

Atlantic City police did not release the shooting incident nor the arrest publicly.
