A.C. school board to vote on lawyer for superintendent in lawsuit by Frazier victim's mom

The Atlantic City school board is set to vote on a lawyer to represent the superintendent in a lawsuit by the mother of the victim in a child pornography case.
DeCotiis, FitzPatrick, Cole & Giblin is set to defend Barry Caldwell in the case of Jane Doe v the Atlantic City Board of Education. It is not to exceed $25,000.
The item is on Tuesday night's agenda, which was not posted where the agenda's are normally made public. Instead, it was with the Zoom link to the meeting.
No one with the district responded when asked why the agenda was not on the school district's website.
The lawsuit also names Mayor Marty Small and his wife, High School Principal Dr. La'Quetta Small, claiming they knew about the crimes of Kayan Frazier when he groomed and sexually assaulted her son.
Frazier, who is Dr. Small's cousin, was substituting at Pennsylvania Avenue School when he met the victim. Dr. Small was principal at Pennsylvania Avenue at the time.
Dr. Small is the one who reported Frazier was having the boy sleep at his home in 2017, but a timeline shows she waited two months before notifying anyone of the issue, which violates district policy.
He was later fired, and then hired by the state Department of Children and Families, where he was a caseworker at the time of his arrest in April 2019.
There is currently an independent investigation into what happened back in 2017, for which the school board has so far approved $100,000. Much of that money is for hours spent fighting to get information, as the district has not been cooperative, sources told BreakingAC.
The firm is supposed to address the board during executive session at Tuesday's meeting.
That discussion is expected to include a grand jury subpoena sent in connection with the Frazier issue, BreakingAC has learned.
