Two Northfield sisters accused of running a drug-production facility in Pleasantville have been released as their case continues.
Megan and Kelly Flinn were arrested Feb. 14 at a home , along with Leroy Gist, who lives in the North New Road home that was raided.
A warrant brought State Police to the multi-unit residence, where they found a variety of drugs, two rifles and ledgers appearing to keep track of drug sales, according to the affidavits obtained by BreakingAC.
Neither of the Flinns lived in the home, each of their defense attorneys argued at their separate detention hearings.
However, Kelly Flinn's charges list her address as the same one as Gist.
The 30-year-old woman was a guest asleep upstairs when the raid happened, attorney Robert Boney told the judge Monday.
He did not respond to requests about the address discrepancy.
"I'm giving her the benefit of the doubt that she may have been in the wrong place at the wrong time," Judge William Miller said in releasing her Monday.
She will have to check in with the court every other week.
Boney said he has applied Kelly Flinn to Recovery Court, even though she faces first-degree charges and a weapons offenses.
The judge said he will allow her a chance to be evaluated for that program, but "if she steps one foot out of bounds, she's going to be back in jail."
The public safety assessment, which helps determine whether a defendant is held under bail reform, recommended both sisters be held.
Megan Flinn, 27, whose address is listed as a residence on Shepherd Circle in Northfield, was released last Monday, after attorney Anthony Imperiale successfully argued against her detention.
He said Megan Flinn not only does not live at the address, but that she was not in possession of any drugs.
Imperiale indicated that the search warrant named only his client's sister and Gist.
Judge Nancy Ridgway told Megan Flinn that she initially planned to detain her but that Imperiale's arguments changed her mind. She ordered Megan Kelly to check in with the court weekly.
Now Kelly Flinn will be released to the same address as her sister, which a property search shows also is listed as Gist's current address.
Miler ordered her not to have contact with witnesses but made no conditions about contact with her co-defendants.
"Usually the females are not the leading instruments in these drug-distribution networks," the judge said.
Instead, he said they often are "more of a mule, like a worker rather than a kingpin."
