The accused teenage killer of a Ventnor grandfather is asking to be moved out of the Atlantic County jail after he wound up with a broken arm.
Since then, Delgado has had five birthdays, been waived up to adult court and been charged with attacking a worker at the juvenile detention center where he was previously held.
In 2020, an appellate panel overturned then-Family Court Judge Susan Maven's decision to keep him in the juvenile system.
Juvenile defendants waived up to adult court can stay in a juvenile facility due to their age unless the state makes a motion to move them. But, in Delgado's case, it was he who asked to be transferred to the Atlantic County Justice Facility.
His mother, Susana Fischer, indicated he had his reasons at the time, but has declined to comment on those reasons.
When commenters on social media raised concerns about the then-teen's safety in an adult facility, Fischer said that her son "knows how to protect himself."
It appears instead he has incurred more charges, and at least one injury.
Delgado appeared in court last week with his left arm in a brace. His attorney, Yvonne Maher, told the judge her client's arm was broken and his elbow shattered. She said she asked the Atlantic County Prosecutor's Office to put in a request to have him moved.
Chief Assistant Prosecutor Kathleen Robinson said she would go back to her office with the concerns about his placement.
Maher would not comment about how Delgado was injured.
Fischer said her son claims it was staff.
But charges filed against her son allege he has been the aggressor.
Delgado was charged with aggravated assault on a corrections officer in August, according to court records. It was not clear if that was the same time he was injured.
The incident that led to his injury is under investigation, according to county spokeswoman Linda Gilmore.
Delgado is due back in court next month, when he is expected to take a plea deal in the case.
