A trial date is set for an Atlantic City man charged with leaving the scene of a crash that killed a pedestrian in 2022.
Jacobs appeared in Cape May County Superior Court on Monday.
The case was briefly moved out of Atlantic County due to an undisclosed conflict in the courthouse, which no longer exists, BreakingAC was told.
A conference hearing is set before Judge Bernard DeLury — who heads the criminal courts in both counties — on Sept. 23.
Trial is set for Oct. 7, although it was unclear whether that would happen. Jacobs' attorney, Lou Barbone, has several trials back to back, according to associate Mary Linehan, who appeared in Barbone's sted Monday. He is in trial in Cumberland County.
Cape May Superior Court Judge Christopher Gibson asked if there was any chance at resolution before trial.
Atlantic County Chief Assistant Prosecutor Seth Levy said that he had more conversations with Linehan and that the defense knew where the state stands. "It's now in their court."
But no details have been made public on any potential plea offer in the case.
Orlando Fraga, 76, was walking east on Atlantic Avenue when he was struck. He died at the scene.
Jacobs left the scene after hearing a man he allegedly waved down on the phone with police.
But even if that is true, it wasn’t enough, according to the state.
“The defendant didn’t stick around to do his legally obligated duty, which is to wait for the police,” Levy said at the September 2022 hearing.
Jacobs was released with conditions, which included living with his father, political powerbroker Joe Jacobs, in Linwood.
The elder Jacobs was referenced several times during the detention hearing. His son attended Monday's hearing alone.
Fraga, whose obituary lists his last name as Fraga-Seruti, was known as Big Cuba, in honor of his birthplace. He moved to the United States in 1980 for “new beginnings,” his obituary read.
Four years later, his only son was born. He also left behind a grandson, granddaughter, three sisters and a brother.
