An Egg Harbor Township man is charged with vehicular homicide in a hit-and-run crash that killed a bicyclist in February.
Shawn Duffy, 39, was traveling south on Steelmanville Road just south of Ocean Heights when he struck the bicyclist near the area of Beaver Drive, and kept going, according to the affidavit of probable cause.
Neil Burman, 68, also from the township, was pronounced dead at the scene.
The vehicle was located hours later and Duffy interviewed, BreakingAC was told at the time. He had a valid driver's license.
Neither drugs nor alcohol was considered a factor at the time, Capt. Cherie Burgan said.
But a follow-up investigation determined that Duffy had a blood-alcohol concentration ranging between .04 and .09 at the time of the crash, the affidavit states.
The legal limit is .08.
"An expert in pharmacology, physiology and behavior concluded Duffy was impaired at the time of the crash, which was a significant contributing factor in the crash," the affidavit reads.
Duffy was charged on a summons, and was not jailed.
