An Atlantic City man wounded in an alleged shootout was ordered held in jail this week.
Brian Wilson, 28, was shot in the leg, calf and arm in the incident just after midnight Nov. 5.
A ShotSpotter alert brought police to 1600 block of Arctic Avenue at 12:22 a.m., according to the charges.
Eight 9mm shell casings were found near the corner of Kentucky and Arctic avenues, with 12 more 9mm casings found at the entrance to Renaissance Plaza nearby, the affidavit of probable cause states.
A blood trail led to a vehicle with Wilson bleeding in the passenger seat, the affidavit states. Michael Mack was in the driver’s seat. Mack was not charged with a crime.
A handgun was found where Wilson had been sitting, Assistant Prosecutor Nicole Campellone said during his detention hearing. It had an extended magazine with six bullets, including one in the chamber.
Wilson had just been released from jail about a week earlier, after a judge denied the state’s motion to revoke his pretrial release, Campellone noted.
That was after his sixth arrest this year, according to court records.
An investigation conducted by detectives from the city’s Violent Crimes Unit would find that Wilson exchanged gunfire with Kahree Nesbitt, 31, of Atlantic City, Capt. Kevin Fair said in a release.
Nesbitt then allegedly fled with 19-year-old Jabez Witherspoon, also of Atlantic City.
Detectives tracked the movement of the men, and recovered handgun that had been reported stolen.
Nesbitt and Witherspoon were arrested this week. Both are now jailed pending detention hearings.
Meanwhile, Wilson underwent surgery on his left arm, before being admitted to the jail, where he appeared at his hearing via video in a sling.
Defense attorney Jake Bayak said he worries that Wilson will not have the proper care for his wounds in the Atlantic County Justice Facility.
He also noted that Wilson has significant community support, including his mother and girlfriend who is due to give birth to their child in January.
But Judge Jeffrey Wilson — who is not related to the defendant — cited Brian Wilson’s continued arrests, including several gun charges despite being a certain person not to possess a weapon since a 2020 conviction.
“This gentleman’s behavior appears to have gone unabated and he’s been given several opportunities not only with pretrial monitoring but also surviving a prior motion to revoke pretrial monitoring,” the judge said.
The shooting happened just a block of the public library and next to the AtlanticCare HealthPlex, “which makes this type of gunfire going on on our streets a definite threat to the safety not only of the victim but our community at large,” the judge said.
Judge Wilson also found defendant Wilson guilty of violating pretrial monitoring and revoked his release.
Brian Wilson will remain in the Atlantic County Justice Facility.
