The lawyer for a man accused of killing his girlfriend's father will file a motion for the victim's medical records as part of his defense.
Lawrence Reid, 33, is accused fatally beating 60-year-old Kenneth Lea inside the Corbin City home they shared.
But the defense is expected to argue that Lea's previous medical conditions contributed to the man's death.
Defense attorney Michael Schreiber told the judge he has hired a pathologist but that she needs Lea's meedical records, which the state told him would require a motion.
Lea previously suffered three heart attacks and underwent surgeries that included heart bypass and stints, Schreiber previously said in court.
The two men allegedly fought after Reid returned home March 17, to find that Lea had given his daughter -- Reid's girlfriend who was in recovery -- methamphetamine.
Reid allegedly admitted to striking the older man 10 times until the victim "went to sleep," according to the charges.
Preliminary autopsy results found cocaine and amphetamines in Lea's system.
At Reid's detention hearing in April, Schreiber said he was still waiting for the final autopsy results.
Assistant Prosecutor Rick McKelvey said at that time that it was not yet known whether the victim's health would be a contributing cause to his death but that "even if it is, it is quite clear … this death would not have happened if not for the repeated assault on the head and face of the victim by the defendant."
Reid is due back in court Jan. 2
