A Philadelphia woman was given a county jail term for brandishing a gun on the Atlantic City Boardwalk during a large fight last year.
The state is appealing the decision.
Shania Simon, 23, admitted Sept. 1 that she had a handgun during a fight involving a large group around Tennessee Avenue on May 30.
Video showed that after the fight was over, Simon pulled out a handgun and waved it in the direction of several people.
When police stopped Simon, they found a black Glock 42,. 380-caliber handgun loaded with six hollow-point bullets in her purse.
Simon had a valid permit to carry the firearm in Pennsylvania, but it was not legal in New Jersey.
The plea called for three years in state prison, with one year of parole ineligibility. Judge Bernard DeLury sentenced Simon to 364 days in the county jail and three years of probation.
She has already served 94 days, leaving 270 with the option of day reporting.
That sentence is on hold while the state appeals.
(The Atlantic County Prosecutor's Office originally reported Simon was not given any jail time. The story, which originally ran April 17, has been updated to correct that information.)
