A Mays Landing man who served time for the 2015 stabbing of his mother now will stay jailed in her killing last month.
Daly served a four-year term for attempted murder in the March 3, 2015, attack.
Melba Daly filed a restraining order at that time. It did not appear that was still in place at the time of her death.
The affidavit of probable cause lists his address as his mother's home.
Sean Daly's uncle called police at about 11:30 a.m. March 20, saying he believed an assault had occurred, according to the affidavit.
Police arrived to find Melba Daly, 74, dead with a knife in her neck.
Her son allegedly admitted to killing her.
Daly's defense attorney said he suffers from mental health issues, including bipolar disorder.
But Judge Pam D'Arcy noted that he would have had those same issues in 2015, and it was not enough to keep him out of prison for that crime.
Under bail reform, first-degree murder is one of the charges that presumes detention. The defense did not overcome that presumption, D'Arcy said.
She noted Daly is possibly a danger to himself, and definitely a danger to family members.
He will now remain jailed pending the outcome of the case.
