An Atlantic City police officer accused of raping a handcuffed woman in his patrol vehicle will have a detention hearing Wednesday.
Joshua Munyon, 24, of Egg Harbor Township, was arrested Thursday on charges of first- and second-degree aggravated sexual assault, along with second-degree official misconduct.
He appeared briefly in court Friday, via video from the Cape May County Correctional Facility, where he is being held. Attorney Lou Barbone is representing him.
During the appearance, Munyon was shown a video explaining his rights and informed that the Atlantic County Prosecutor's Office has filed a motion to detain him. His hearing is set for Wednesday.
Munyon shook his head as Judge Timothy Maguire read the charges against him.
The victim came to Atlantic City police Sept. 13, saying she was sexually assaulted by the officer after having multiple contacts with him earlier that morning in his official capacity as a uniformed police officer.
That included a motor vehicle stop, she told police.
The woman told investigators that Munyon served her with a summons for being intoxicated at the Tropicana Casino.
He then drove her to a parking lot, telling her that he would drive her back to the casino if she performed a sexual act on him, according to the affidavit of probable cause obtained by BreakingAC.
After she did what he said, he then raped her, she said.
The woman told police she did not consent, but felt she had no other option as she had no other method of transportation, and no way of getting in touch with the person she was traveling with, the affidavit states.
Munyon then allegedly drove her back to the Tropicana, where she told security staff what happened.
She had injuries to her wrists from the handcuffs, and chipped toenails from how she was positioned in the vehicle during the assault, according to the report.
After police were called, the Atlantic County Prosecutor's Office Special Victims Unit was dispatched.
An investigation found video surveillance depicting A.L. getting in and out of Munyon’s patrol vehicle as well as location data that detailed his route, corroborating the woman's allegations.
Munyon denied to supervisors that the woman was ever under arrest or inside of his vehicle, the affidavit states.
He was transferred to the Cape May County Correctional Facility from the Atlantic County Justice Facility shortly after he was arrested.
Munyon, who was hired in August 2022, was placed on a modified assignment during the investigation, according to a statement the Atlantic City Police Department provided to BreakingAC.
He has been suspended without pay pending the outcome of the criminal matter.
Munyon was among a group of 29 Special Law Enforcement Officers Class II who were promoted to full-time officers in 2023. He graduated the academy that February.
Mayor Marty Small had no comment.
