The Mizpah fire chief and another firefighter are criminally charged after an investigation that temporarily shuttered the Volunteer Fire Company.
Chief Jay Davenport II and Craig Paxton, both 38, are accused of official misconduct, theft and conspiracy, Atlantic County Prosecutor Damon Tyner said Thursday.
The charges are in connection with allegations that an unauthorized account or accounts was set up at NAPA Auto Parts using the company's funds and tax-exempt status.
Chief Assistant Prosecutor John Flammer represents the case in the matter.
Paxton and Davenport were released on summonses. Their first appearances are scheduled for Oct. 28.
Davenport referred comment to his attorney, but did not say who is representing him.
