N. Wildwood dismisses charge against Attorney General's Office detective

A defiant trespass charge against a sergeant with the state Attorney General Office was dismissed Tuesday.

Danielle Oliveira, 32, was arrested Sept. 24, after she was accused of trying to sneak back into a North Wildwood bar several times after being kicked out.

Her attorney later called it a false arrest due to an illegal charging document.

Oliveira was on the sidewalk when she was arrested, and there is no such charge as attempted trespass, attorney Timothy R. Smith said.

On Tuesday, the municipal prosecutor agreed.

"Yesterday, justice was served and the complaint against Mrs. Oliveira was rightfully dismissed," Smith said Wednesday. "As we maintained from the outset, Mrs. Oliveira's arrest was a complete injustice because it stemmed from her being charged with an alleged offense that did not exist under the law, and was based upon supposed facts which did not comport with the reality of the situation.

"We thank the prosecutor for seeing this, doing the right thing, implementing swift justice and dismissing the case," Smith added. "You do not see such a high degree of professionalism these days. Mrs. Oliveira has suffered unduly from her false arrest and is greatly relieved by her full and well-deserved vindication."

Oliveira is assigned to the Attorney General's Office of Public Integrity and Accountability, which is tasked "to investigate violations of public trust and to develop policies that would rebuild faith in both government and our criminal justice system," according to the agency's website.

Another member of the office, Lt. Cortney Lawrence, was also in North Wildwood that night and told a lieutenant on scene that she didn't know why her friend was denied re-entry to Keenan's Irish Pub.

Several other people had been let back into the bar to which Oliveira had previously paid entry and had a wristband for, Smith told BreakingAC.

He called the arrest "a civil rights violation of monumental proportions."

The arrest did not become public until BreakingAC reported about it on Oct. 15.

Four days later, the Attorney General's Office announced the Ocean County Prosecutor's Office was tasked with independently reviewing the situation "in an abundance of caution and to avoid the appearance of a potential conflict."

It's not clear where that stands now that the charge has been dismissed.

Smith said he handled only the criminal issue, which no longer exists.

"There's nothing other than people being held to account for being involved in this false arrest," he said.
